Date: 13 Apr 1999 01:17:00 +0200 From: I-AFD_2-AT-anarch.free.de (Nico MYOWNA) Subject: Rambouillet-draft agreement (was Germany and the KLA) Hi all, This are some paragraphs from the "agreement" of Rambouillet: (FRY = Federal Republic of Yugoslavia [Serbia, Kosovo, Montenegro]) "At all entry and exit points to/from the FRY, NATO personnel shall be permitted to enter/exit the FRY on production of a national identification (ID) card. NATO personnel shall carry identification which they may be requested to produce for the authorities in the FRY, but operations, training, and movement shall not be allowed to be impeded or delayed by such requests.(...) NATO shall be immune from all legal process, whether civil, administrative, or criminal. NATO personnel, under all circumstances and at all times, shall be immune from the Parties' jurisdiction in respect of any civil, administrative, criminal, or disciplinary offenses which may be committed by them in the FRY. (...) NATO personnel shall be immune from any form of arrest, investigation, or detention by the authorities in the FRY. NATO personnel erroneously arrested or detained shall immediately be turned over to NATO authorities. NATO personnel shall enjoy, together with their vehicles, vessels, aircraft, and equipment, free and unrestricted passage and unimpeded access throughout the FRY including associated airspace and territorial waters. This shall include, but not be limited to, the right of bivouac, maneuver, billet, and utilization of any areas or facilities as required for support, training, and operations. (...) The authorities in the FRY shall facilitate, on a priority basis and with all appropriate means, all movement of personnel, vehicles, vessels, aircraft, equipment, or supplies, through or in the airspace, ports, airports, or roads used. No charges may be assessed against NATO for air navigation, landing, or takeoff of aircraft, whether government-owned or chartered. Similarly, no duties, dues, tolls or charges may be assessed against NATO ships, whether government-owned or chartered, for the mere entry and exit of ports. Vehicles, vessels, and aircraft used in support of the operations shall not be subject to licensing or registration requirements, nor commercial insurance. (...) NATO shall be allowed to contract directly for the acquisition of goods, services, and construction from any source within and outside the FRY." I quot this to support my "clumsy and incoherent" (in the words of Dave Hayman) argumentation. This agreement show:" NATO is immune from all legal process wether civil, administrativ or legal. The NATO enjoy free access throughout the whole FRY and the right to billet and utilization of any areas or facilities in the whole FRY." No state of souveranity acept a dictation *before* a lost war. The NATO shall be here a state of souvera- nity inside the federal state of Yugoslavia -- in fact a occupation army outside of every federal law of Yugoslavia. At the first time since the start of war the NATO today say, that "they dosn't whant the leading position in the international military force, who should supervise the return of the refugees and the implementation of the Rambouillet-agreement", german media reported. This show that the diplo- macy have in fact full scope and wasn't at a point of 'ultima ratio' with- in the end of Rambouillet. Support NATO and you run the risk of strengthening a hegemonic alliance already stronger than any the world has ever seen. Oppose NATO and we ab- andon the only abvious and effective response the gravest treat to human life in europe since 1950 (not WW II, Roger! Doesn't forget the 2 500 000 german victims in Polen and Czechslovakia 1948/49). So we can support in realpolitic the UN for an solution run by international law and condemn the NATO as criminal with their war of agression without a resulution by the UN court. And we can for example proclaim to build up voluntary para- military forces like the international brigades in Spain 1936/37, who are independent from any state try to support and to defend the people in con- sistence to the international law in a region of crisis against genocide, carnages and ethnic cleansing (as a NGO). Or we try to sabbotage the ca- pitalist war maschine in ewery country of this world by demonstrations, desertation and strikes against the production of weapons for war.... I doesn't understand Carp & Bart: Both speak about a genocide at the Koso- vo. But one year ago have Carp wrote:"'10%' is called 'decimation'. We over here usually reserve that word [genocide] for 50% and more." There have been before the war 1,96 Mill. inhabitants at the Kosovo, 87% ethnic Albanians, 8% ethnic Serbs, 4,5% ethnic Bosnians and 1,5% ethnic Turks. The NATO say that now are 960 000 ethnic Albanians are out. 1 705 200 ethnic Albanians have lived there. More than 50% are still alive at the refugee camps. More than 400 000 should be still alive in the woods of the Kosovo. A genocide? Or something, what we name as 'decimation'? No, carp, I doesn't support the Yugoslavian authorities: As anarchists we acept the inalienable human dignity of every person to fulfill themself in their own way of living. Therefore we have to condemn every person or orga- nisation, who deny an other person his/her inalienable human dignity through ethnic cleansing, murdering and insulting. We have to condemn the operation "horseshoe" by the Yugoslavian army and their paramilitary groups as well as the carnage against ethnic Serbs by the KLA. We cannot condemn the Yugoslavian army and ther allies and oversee the crime of the KLA, because this group seems to be "on our side", if we respect our claim of egality.
