Yes, but they are trying to amend the constitution itself thus making it constitutional. They aren't just trying to pass a law here. If 3/4 of the states approve it, it will become a part of the constitution. And if it becomes a part of the constitution, the supreme court can hardly call it "unconstituional." However, I think it will be a hard sell. There only needs to be 13 states that oppose it. And amending the constitution isn't very common. It has only been done 17 times since the first 10 amendments (the bill of rights) were ratified in 1791.
