Levine MTA Half Fare Fairness Coalition Additional background information is below: The Half Fare Fairness Bill passed the Legislature by a huge majority in both Houses, and was signed by Governor Pataki on August 31, 1999. But now, after the Governor and Legislature have spoken, the MTA is refusing to implement the new Law on New York City Buses and Subways. The MTA's Law Department claims a "technical deficiency" in the new Law; citing a technical failure to cross-reference a sub-Section of the Public Authorities Law. Most legal experts believe that the MTA never needed a new Law in the first place to bring fairness to the New York City Buses and Subways. Most legal experts believe that the new Law is plain on its face and covers New York City buses and subways as originally written. To his credit, Senator Frank Padavan, our staunch Senator Sponsor, has been trying valiantly to get the MTA to voluntarily implement the Law. He has assured the MTA that he will seek a "corrective" amendment this Session. He requested that the MTA voluntary act to bring about fairness now while the "corrective" amendment moved through the Legislature. Chairman Conway flatly refused. For the MTA to hide behind a claim of "technical deficiency" places technical form over personal recovery and rehabilitation and is outrageous.
