THE TIME IS *NOW* TO GET BUSY FOR MUMIA!

The Supreme Court of the State of Pennsylvania denied Mumia Abu Jamal's appeal
today.

The decision was signed by Justice Ronald Castille.

What does this mean?

1. A new death warrant is imminent. Governor Thomas Ridge had promised to
issue (sign) a new death warrant on Mumia as soon as his appeal was denied.

2. If the Governor does not sign the death warrant, the head of the
Pennsylvania Department of Corrections can sign the warrant and issue a date
for execution and carry it out within 30 days.

3. Once the death warrant is signed, Mumia would immediately be moved into
Phase I again where he would be isolated and await the execution or a new
stay.

What can we do?

1.Mumia's attorneys are prepared to go into Federal Court to ask for a stay
of execution once the warrant is signed.

2. We will file papers in Federal Court for a habeas.

3. We are asking for demonstrations to be held across the country. Get the
word out about what has happened and organize demonstrations.

4. Now, more than ever, we need for people to reach out and get involved.
Justice Ronald Castille, the person who signed the decision denying Mumia a
new trial, was a signator on the papers from the District Attorney's office
denying Mumia's original appeal. Having worked on this case from the outset,
Ronald Castille could not be objective in determining whether Mumia's
conviction should be overturned.

Call (215) 476-8812, the International Concerned Family and Friends of Mumia
Abu Jamal, to find out what you can do and what the next step should be.

FOR RELEASE OCTOBER 30, 1998

Pennsylvania Supreme Court Denies Fair Trial for Mumia Abu-Jamal
Refuse & Resist! Urges International Protests

Demonstrations are expected throughout United States and internationally
in response to Friday's decision by the Pennsylvania Supreme Court to deny a
new trial to radical journalist Mumia Abu-Jamal. If Pennsylvania carries
out its threat to execute Jamal, it will be an international incident
comparable to Nigeria's execution of author Ken Saro-Wiwa.

Refuse & Resist! National Secretary, Dr. Robert Rockwell, said: "People
have every right to be angry and demonstrating in the streets when a court
of law (1) accepts the bogus claim of police officers made two months
later that Mumia "confessed" but none of them thought to report it at the
time,
(2) lets stand the removal on jurors on the grounds of race after the U.S.
Supreme Court has outlawed the practice, and (3) holds the blatantly
pro-prosecution judge was fully justified in barring key evidence from
both the trial and the post-conviction hearings."

The Pennsylvania Supreme Court unanimously let stand a lower court
decision denying a new trial, and the Gov. Tom Ridge has promised to quickly
sign a new death warrant.

In rejecting the appeal, and all the evidence amassed in over two years
of hearings, the Pennsylvania Court is in step with the national political
program of both major parties to reject appeals from death row inmates, no
matter how meritorious, and expedite executions.

The Pennsylvania high court is elected in partisan political elections,
in which some of justices received the endorsement of the Fraternal Order of
Police which has campaigned for Jamal's execution.

In response to the FOP campaign, hundreds of prominent people signed a
full-page ad that recently appeared in the New York Times (October 16, New
York edition) demanding a new, and for the first time fair, trial for
Jamal.

At a conference earlier this year, the International Concerned Family &
Friends of Mumia Abu-Jamal called on people to respond to any negative
court decision with immediate calls to the media, demonstrations in their
local
area on the next work day, and regional demonstrations the following
weekend.

In California, an emergency demonstration for Mumia Abu-Jamal has just been
scheduled. Why? The Pennsylvania Supreme Court has just ruled against his
appeal for a new trial. His death warrant is expected to be signed
imminently.

The demonstration will take place Saturday, October 31, at 1:00 PM, at
Powell and Market streets in San Francisco. For more information, call
Mobilization to Free Mumia Abu-Jamal at (415) 821-0459

Mumia's legal team is expected to appeal the Pennsylvania decision to the
Federal level.

For the moment, the PA Supreme Court's decision bumps the life-or-death
decision back into the lap of Pennsylvania Governor Thomas Ridge. Based
upon his past actions in similar situations, Governor Ridge may be expected
to sign Mumia's death warrant at any time.

You may send an email to Governor Ridge from the following web site:
<http://www.state.pa.us/PA_Exec/Governor/govmail.html>
Howewer, there is a note at the site saying that his email will be
unavailable from November 3-5, and that folks should kindly call the
Governor at 717-787-2500 during that time.

Somehow I have a hunch that the Governor will be receiving a quite a few
more emails and calls than usual during the next couple of weeks.
