Subject: BHA: Critique needed!


 
 
I have an article on contract formation slated for February
publication by the Seton Hall Law Review.  The piece makes
extensive use of Bhaskar and the second section, in particular,
reviews essential propositions of Critical Realism for
"orientation."  This is a general review of concepts like
stratification, openness, real definition, social structure and
agency, etc.  I'd be very grateful to any members of the list who
would be willing to review these pages to catch errors, give me
their suggestions, etc.  I mean it about catching errors.  This
stuff is tricky.  Just the recent exchange regarding Tobin's
proposed ontologies makes me realize I probably need to change my
own summary of Bhaskar's three domains.  In any event I would

Hans E, how do I make these portions of the draft (about 25 double
spaced pages) available to the list?  You had earlier mentioned
some sort of bank for this purpose.

Also if there is anyone interested enough in law to work through a
somewhat technical argument about the anglo-american legal doctrine
of "consideration," an essential requirement for establishing the
binding nature of a contract and for enforcing promises, I'd love
to make the entire draft available to them for review.  That is,
the doctrine is somewhat technical; I don't think my argument
really is.  There's too much Bhaskar in it for that.
