Eric,
I regards to our discussion in INC I would
like to add that the discourse principle as the site
of legitimation is also what underlies Habermas'
critique of Weber's notion of legitimacy (nad Luhmann's for
that matter) insofar as a procedure in-and-of-itself
cannot be legitimate. In BFN this notion is carried over

with his assertion that underlying the legitimacy of legal proceedures
is a belief in the rational conscencus of  a speech community.
