One person who immediately springs to mind is Bill Scheuerman.  Working off
of Neumann (and in the long version, Kirchheimer), he argues that Habermas
should take legal formalism much more seriously in the face of the
"materialization" of law.

"Neumann v. Habermas: The Frankfurt School and the Case of the Rule of
Law," _Praxis International_ 13:1 (1993) 50-67.

_Between the Norm and the Exception: The Frankfurt School and the Rule of
Law_ (MIT Press, 1994).
