yesterday I received the latest number  of "ASSOCIATIONS. Journal for Legal and 
Social Theory" ( = vol. 4 <2000>, Nr. 2) with a contribution of Armin Englaender 
on "The Failure of Discourse Theory; Critical remarks on HabermasīMoral and 
Legal Cognitivism" (pp. 223 - 251). Perhaps this might be of interest for you. 
Not having read the article yet I cannot say anything about it in detail.
