Two questions now to you in turn:

1) If this is the correct procedure then what is the difference between it 
and Kant's transcendental deduction?

2)Can you pinpoint a particular passage from Habermas to substantiate your 
logic above and if you can refer to any secondary source I would be 
grateful.
