Thanks, Antti. Your explication helps. 

That assertion from my earlier email that you quoted at the
end of your posting does indeed need unpacking. I was
thinking at the keyboard. I'm going to let it remain
unpacked. 

I've wanted to read Scanlon's _What We Owe To Each Other_,
but haven't been inspired yet to do so (though I own the
book). Maybe you will cause me to make him a higher
priority. Let me know your assessment of his
contractualism. Prima facie, contractualism isn't very
appealing to me outside of theory of law, which is of
secondary interest to me currently.
