I want to add a remark to my own post.  I have recently read Simone  Chambers 
latest article in Constellations, Jan 2004, I believe.  She  describes 
constitution making in terms of the norm of popular sovereignty.   She tells the 
story of the constitution-making in South Africa and in Germany  after the 
reunification.  The story she tells of South Afrika is one of  participation by the 
populus.  But, the story of Germany is quite  different: the new constitution 
was rewritten without any input from the populus  after deliberations 
determined that it might be too burdensome!!!  So,  Raul, in response to your 
accusation of fascism, conservative politicians who  are either too cowardly or too 
dominant should be judged.
