Michael and Justin,

Do you think it is correct to say that legal discourse on due process in
the US, especially that of the advocates of judicial "restraint" and
"states' rights" (but not limited to them), has been profoundly shaped by
the history of slavery and racism? My spotty reading tells me so, but I
have no deep legal knowledge to really back it up.
