Of course in Goethe's masterwork, Faust escapes because he bet Mephistopheles 
that he cannot make him happy, even for an istant. At his death, Faust says 
he's happy, and Mephistopheles claims victory. However, Faust used the 
subjunctive mood, and so Heaven claims him after all. However, there is no way to 
translate that into English. 

Earlier in the script, though, when Hanswurst and Mephistopheles are 
jockeying for a deal, Hans points out that he has no soul because he's made out of 
wood.
